1. Agreement to Terms

By accessing or using JobFitstr ("Service", "we", "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not use our Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Service Description

JobFitstr provides AI-powered resume generation and validation services. Our Service:

• Generates tailored resumes from your CV and job descriptions using AI (Anthropic Claude)
• Provides resume quality reports with hallucination detection metrics
• Validates existing resumes for ATS compatibility (free tool)
• Stores your CVs and generated resumes securely (encrypted)

3. Account Registration

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account and password
• You must notify us immediately of any unauthorized use of your account
• You must be at least 16 years old to use the Service

3.2 Account Termination

We reserve the right to terminate or suspend your account at any time for violations of these Terms, fraudulent activity, or abuse of the Service.

4. Subscription & Billing

4.1 Subscription Tiers

4.2 Billing

• Subscriptions are billed monthly in advance via Stripe
• All fees are non-refundable unless required by law
• Prices may change with 30 days notice (existing subscribers grandfathered for 90 days)
• Failed payments may result in service suspension

4.3 Cancellation

• You can cancel your subscription anytime from Settings
• Cancellations take effect at the end of the current billing period
• No partial refunds for unused time
• After cancellation, you retain Pro access until period end, then downgrade to Trial

5. Usage Limits & Fair Use

5.1 Monthly Quotas

• Trial: 3 resumes/month
• Pro: 50 resumes/month
• Quotas reset on the 1st of each month
• Deleted resumes still count toward quota (to prevent gaming)

5.2 Prohibited Use

You may NOT:

• Resell, redistribute, or commercialize our Service without permission
• Use automated tools (bots, scrapers) to access the Service
• Attempt to reverse-engineer our AI prompts or algorithms
• Upload malicious content (malware, viruses) via CV uploads
• Use the Service for illegal purposes (e.g., fake credentials)
• Share your account with others (one account per person)
• Create multiple accounts to circumvent quotas

6. AI-Generated Content

6.1 Accuracy & Quality

Our Service uses AI (Anthropic Claude) to generate resumes. While we provide quality reports and hallucination detection:

• You are responsible for reviewing all generated content before use
• We do not guarantee 100% accuracy or suitability for any specific job
• AI-generated content may contain errors, hallucinations, or inappropriate phrasing
• You must verify all facts, dates, and claims in generated resumes

6.2 Ownership

You retain full ownership of your original CV content and generated resumes. We claim no intellectual property rights over your content. However, by using the Service, you grant us a limited license to process your content for the purpose of providing the Service.

7. Intellectual Property

7.1 Our Property

The Service, including software, design, text, graphics, logos, and underlying technology, is owned by JobFitstr and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of content you upload (CVs, job descriptions). By uploading, you grant us a non-exclusive, worldwide license to use, store, and process your content solely to provide the Service.

8. Privacy & Data Protection

Your use of the Service is governed by our Privacy Policy. By using the Service, you consent to:

• Processing of your CV and job descriptions by Anthropic (Claude AI) via secure API
• Storage of your data on Railway (database) and Vercel (frontend)
• Payment processing by Stripe
• Email communications via Resend

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so the above may not fully apply to you.

You agree to indemnify and hold JobFitstr harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Violation of these Terms
• Infringement of any third-party rights
• Use of AI-generated resumes (e.g., if content is inaccurate or misrepresented)

12. Governing Law & Disputes

12.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

12.2 Dispute Resolution

• Informal Resolution: Contact support@jobfitstr.com first to resolve disputes informally
• Mediation: If unresolved, we agree to attempt mediation before litigation
• Jurisdiction: Courts of England and Wales have exclusive jurisdiction

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

• Immediately upon posting for non-material changes
• After 30 days notice for material changes (via email or in-app notification)

Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.
